Hey, to prove beyond a reasonable doubt I'm not an idiot
I installed the software during the past 5 minutes on my other host. http://www.servicelance.com/ (I'll remove it within hour)
seems to work so i'm back to square one on the other host which probably asks the question... why it works one place not the other. So must be some differences in php which I have not identified.

It comes down to as I stated when you have an issue like this where you are having an install issue its best to delete everything and start over COMPLETELY FRESH. Don't forget to keep your data directory.
Try installing your gallery in your normal domain instead of /forums/gallery to /gallery
There is something about the old directory permissions maybe. What is the permissions of that gallery directory? should be 755

All of my permissions are correct but it generates this error when creating a category . looks like a "/" missing somewhere
Error creating directory /home/.sites/123/site64/web/forum/gallery/data503. Check permissions of your data directory.

must be something on the server to do with permissions when created by photopost but makes no sense since I followed same routine on servicelance and it was all done in 5 minutes from install to upload of one directory

No you do not want to do that
I am trying to understand how your trying to upload a category to a category and the data category does not exist thats why your getting the error. 504 does not exist
when you add a category in admin category editor it creates the directory your 504 directory does not exist hense your error

it keeps choking
Unable to read the format of file: /home/.sites/123/site64/web/forum/gallery/data/504/11waterfowl0041.jpg
but I removed that photo from the upload directory so it's not even there it's choking on something does not exist
on servicelance it bypassed and just uploaded the bulk photos no problemo

when you add a category in admin category editor it creates the directory your 504 directory does not exist hense your error | I bypassed the error by placing the additional "/" to end of URL as noted above.
Then it creates a cat with no subsequent errors. So the 504 directory exists now. And I did delete then recreate with my ftp client. no problem now problem is bulk upload chokes on a image that is not in the directory
