yes which is why it was removed.

So really I will have to do testing with or without it

As stated I am unable to replicate any issues with the code removed either logged in or logged out so its a matter of trying to replicate the issue.

Hippy tell me this. Since I am unable to replicate this issue logged in logged out etc on my site tell me some things.

Using my site as a base before going onto yours etc. Now remember I am using the default code so I have not added anything back in because adding the code back in will definately cause no cookie to be created it will always be deleted which is an issue.

1. Tell me if you can replicate the issue on my site logged in or logged out how does the problem occur.

2. If you cant replicate any issue then we can move on to is it only with seo urls on or off.

Its all about figuring out what variables are in conflict. Hard for me to comment when I can not replicate the issue.
