Issue when uploading into a catagory where not allowed.
I have a private catagory section, where only 1 person may upload to. However, before I set that, a member loaded the page and thus saw the option of uploading to that catagory. He selected the catagory and managed to upload to it.

Do you have the category is hidden or private based upon permissions and/or password? If you just have the category hidden then anybody can upload to it if they know the category ID.
