When an item is marked as SOLD...

... does it count toward the user's total number of ads?

IE: If a user has five ads that are marked SOLD, and there is a five ad maximum (as set in the admin panel), can that user post more ads?

Yes all ads count. are you not using your sendnotice.php cron script to expire ads and then are you deleing your ads in expired que?
