ignore watermark in category issue

i have a global watermark set for the gallery. However in two of my sections i have it disabled.
Now see the attachment.

Uloading the images, however in that category, i still have the watermark shown. Any fix on this?

the above category is set to non-watermark
However i uploaded this image

and i still ended up having the image watermarked
(i have watermark original image set to disabled btw)
Is this a bug or some setting i have missed?

Just to add, I've got the same issue too. We have a global watermark set in the settings, however I've just created one category on it's own that we don't want watermarked so I've blanked out the watermark path and unticked 'use default' and the watermark is still being applied.
